16. 延期交货和惩罚条约 Late Delivery and Penalty假如有一方没能根据合同规定的交货时间交货，或者没能完全履行合同，另一方的利益必然要遭到损害。延期交货和惩罚条约就是为了预防出现利益纠纷而设置的。大家通过两段例文来看看这个条约都要具体规定些什么：例1：假如乙方因自己缘由而未按时完工，乙方应对违约罚款，天天按总价的千分之一计算，即一千二百六十USD整。If party B fails to finish the work on schedule due to party B's own actions, he shall pay to the other party the penalty at 1 of the total value of the work per day, that is 美元 one thousand two hundred and sixty dollars.例2：假如合资一方未能按本合同第5条规定按期付款，违约方应在逾期后一个月付给另一方10%的利息。假如违约方逾期3个月仍未付款，合同另一方依据本合同第53条规定有权终止合同并向违约方索赔损失。Should either joint-venture fail to pay the contribution on schedule according to Clause 5, the default party should pay the other 10% of the interest one month after the deadline.
